There are a number of factors that affect your entitlement in the compromise agreement, including:-

  • The manner in which your employment was ended
  • The length of time you were employed
  • Your lost earnings
  • Your prospects of success in an Employment Tribunal claim such as unfair dismissal

As part of the negotiations, we will also seek to ensure that you receive the compensation in the most tax efficient way. If you are receiving a payment in lieu of notice in your compromise agreement, it may be possible to re-draft the agreement slightly to ensure that you receive it free of tax.

We will also advise you on your options if you are not happy with the agreement. This may include bringing an Employment Tribunal claim against your employer. Although you may prefer to avoid such a claim, your right to do so can often be used as leverage to bring about the best possible settlement.
